President Donald Trump has signed an executive order that ends birthright citizenship for children born on American soil to parents who are not U.S. citizens. This order will prevent these children from automatically obtaining U.S. citizenship.
Birthright citizenship, which grants citizenship to anyone born within the U.S. or its territories, is currently protected by the 14th Amendment of the U.S. Constitution. This amendment states that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
During his inauguration on January 20, 2025, as the 47th President of the United States, Trump also prohibited federal agencies from issuing citizenship documents or accepting documents issued by state or local authorities that could recognize U.S. citizenship.
The executive order specifies:
“It is the policy of the United States that no department or agency of the United States government shall issue documents recognizing United States citizenship, or accept documents issued by State, local, or other governments or authorities purporting to recognize United States citizenship, to persons:

(1) when that person’s mother was unlawfully present in the United States and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or
(2) when that person’s mother’s presence in the United States was lawful but temporary, and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth.”
Additionally, Trump extended the deadline for TikTok’s compliance to 75 days.
“I hereby order the Attorney General not to take any action on behalf of the United States to enforce the Act for 75 days from the date of this order, to allow my Administration to determine the appropriate course of action concerning TikTok.”
In his return to the presidency, Trump also halted U.S. foreign development assistance for 90 days to assess programmatic efficiencies and consistency with U.S. foreign policy.
While rescinding 78 executive orders issued by former President Joe Biden, he granted full and unconditional pardons to all individuals convicted of offences related to the events that occurred at or near the United States Capitol on January 6, 2021.
The executive order further declared that the United States government would only recognize male and female genders, effectively eliminating all other gender identities.
It is expected, however, that the executive orders would be legally challenged.
